Terms and Conditions

GENERAL SALES TERMS AND CONDITIONS OF MOSTODOLCE SRL FOR THE MOSTODOLCE BREWERY APP, WEBSITE, AND E-COMMERCE PLATFORM

The MOSTODOLCE BREWERY APP, WEBSITE, and E-COMMERCE PLATFORM are owned and managed by MOSTODOLCE SRL, located at via ValBisenzio, 138/a 59021 Vaiano (PO), Italy.

By accessing the MOSTODOLCE BREWERY APP, WEBSITE, or E-COMMERCE PLATFORM, the consumer agrees to abide by the terms and conditions outlined below, including all related documents. Users are encouraged to carefully review this document before utilizing the services.

SUBJECT OF THIS SALES CONTRACT

This contract concerns the sale of bottled beer, as well as accessories, in the quantity and quality chosen by the consumer through the selection of products on the MOSTODOLCE BREWERY APP, WEBSITE, or E-COMMERCE PLATFORM. The goods and services for sale are those described on the MOSTODOLCE BREWERY APP, WEBSITE, or E-COMMERCE PLATFORM. The data provided may be subject to modifications and periodic updates, aimed at further improving the service for the consumer.

PRODUCT PRICES AND AVAILABILITY

FOR PACKAGING AND SHIPPING REASONS, CARTONS MUST BE FILLED COMPLETELY, INCLUDING MIXED ITEMS (6 BOTTLES FOR 75CL AND 12 FOR 33CL BOTTLES)

Product prices are indicated on the website, app, or e-commerce platform and include VAT. Shipping costs, where applicable, must be added to the product price. If a product is unavailable, the consumer will be promptly informed via email or phone. Prices and product availability are subject to change without notice.

SHIPPING COSTS

Shipping costs are €15 across Italy for orders below €126 (bottles or merchandising items). For orders of €126 or more, shipping is free.

An exception applies to municipalities listed in the “Nexive - Disadvantaged Areas” list, for which an additional fee of €10 is required, regardless of the number of items.

PURCHASE CONTRACTS MADE BY MINORS

Purchases can only be made by individuals who are at least eighteen years old. MOSTODOLCE SRL is not responsible for purchases made by a minor under eighteen who provided false age information or incorrect details to make a purchase or access data on the site, app, or e-commerce platform. In any case, parents are directly responsible for the payment of goods purchased by their children under eighteen.

ORDERS/INVOICING

Orders are accepted through the MOSTODOLCE BREWERY APP, WEBSITE, or E-COMMERCE PLATFORM. The conclusion of the contract is subject to the receipt of the order by MOSTODOLCE SRL.

DELIVERY OF GOODS

Delivery occurs within the terms specified on the website, app, or e-commerce platform, to the address provided by the consumer, through the courier designated by MOSTODOLCE SRL. To prevent fraud, the courier reserves the right to check an ID document to verify that the order details match the credit card holder. Note that to ensure more efficient delivery, MOSTODOLCE SRL will communicate the consumer’s email address or phone number to the courier as provided during registration or at the time of order. These details will be used in compliance with privacy regulations (D.Lgs. n. 196/2003). Upon receiving the goods, the consumer must check their integrity and ensure they match the order in the presence of the delivery agent. If the packaging appears damaged, the consumer must ACCEPT THE PACKAGE WITH RESERVATION and note the damage on the waybill/shipping document. If the package is intact, the consumer can accept it and may sign the delivery receipt with the note “ACCEPTED WITH RESERVATION FOR INSPECTION.” If one or more products are damaged or do not correspond to the order, the consumer, only if they noted the damage on the waybill or accepted it with a reservation for inspection, must inform MOSTODOLCE SRL by email at ecommerce@mostodolce.it within 3 (three) business days from delivery. The consumer must also provide documentation, including photographs, of the damage or incorrect supply, with the burden of proof on the consumer. MOSTODOLCE SRL reserves the right to request the return of the damaged or incorrect goods at the consumer’s expense, to be sent back within 15 days of the request by MOSTODOLCE SRL. Failing to do so results in the forfeiture of the right to replacement or refund. Once the damage or incorrect supply has been verified, MOSTODOLCE SRL will, at its own expense and within no more than 30 days from the delivery or report date, replace the damaged/incorrect products or, if not possible, refund the consumer for their value. If the customer contacts customer service after the three business day period, MOSTODOLCE SRL may choose, at its discretion, to open a claim to potentially replace the damaged/incorrect goods.

DELIVERY TIMES

Delivery may take between 2 and 5 business days. Shipments are made from Monday to Wednesday to prevent goods from remaining in courier warehouses over the weekend. Delivery times are not binding and may vary due to circumstances beyond MOSTODOLCE SRL’s control.

Deliveries near MOSTODOLCE SRL (about 20 km from its headquarters in Vaiano) will be carried out directly by MOSTODOLCE SRL within 48 hours of receiving the order through the MOSTODOLCE BREWERY APP, WEBSITE, or E-COMMERCE PLATFORM, excluding public holidays.

RIGHT OF WITHDRAWAL

Consumers may exercise their right of withdrawal within 14 business days from the receipt of the goods. This right must be exercised by sending a registered letter with acknowledgment of receipt to the headquarters of MOSTODOLCE SRL at via ValBisenzio, 138/a 59021 Vaiano (PO), Italy. The communication may be anticipated, within the same timeframe, by email to ecommerce@mostodolce.it, provided that a confirmation registered letter is sent within 48 hours. Goods must be returned to MOSTODOLCE SRL in their original, undamaged condition and packaging at the consumer’s expense within 15 days from the withdrawal notice. MOSTODOLCE SRL will refund the amounts paid within a maximum of 30 days from the date of receipt of the withdrawal letter, but not before receiving the goods and inspecting their condition. The consumer bears the costs and risks related to returning the products. Please note that under EU law, the right of withdrawal can only be exercised by individuals (consumers) acting for purposes unrelated to their commercial activity. Therefore, it cannot be exercised by legal entities or individuals acting for business-related purposes. The right of withdrawal also excludes purchases made by resellers or those who purchase for resale to third parties.

LIMITATION OF LIABILITY

MOSTODOLCE SRL assumes no responsibility for any damage resulting from the use or misuse of the service provided by the MOSTODOLCE BREWERY APP, WEBSITE, or E-COMMERCE PLATFORM. MOSTODOLCE SRL is not responsible for errors or omissions within the MOSTODOLCE BREWERY APP, WEBSITE, or E-COMMERCE PLATFORM or any referenced or linked websites. MOSTODOLCE SRL reserves the right to continuously update the MOSTODOLCE BREWERY APP, WEBSITE, or E-COMMERCE PLATFORM at any time. Information may contain inaccuracies or typographical errors. MOSTODOLCE SRL does not guarantee that the services provided by the MOSTODOLCE BREWERY APP, WEBSITE, or E-COMMERCE PLATFORM will be uninterrupted, except in cases of reasons beyond the control of MOSTODOLCE SRL. MOSTODOLCE SRL disclaims any liability to the buyer or third parties for direct or indirect damages (including, but not limited to, loss of profits, revenue, or business opportunities) arising from or related to a product or service provided by MOSTODOLCE SRL, or the use or inability to use it. MOSTODOLCE SRL assumes no responsibility for disruptions due to unforeseen events or force majeure, such as accidents, explosions, fires, strikes, earthquakes, floods, or other similar events that prevent the timely execution of the contract. MOSTODOLCE SRL will not be liable for damages, losses, and costs incurred due to the non-performance of the contract for the aforementioned causes, and the consumer will only be entitled to the return of the price paid. Except in cases of intent or gross negligence, the right to compensation against MOSTODOLCE SRL will not exceed the price of the products purchased by the consumer and for which the dispute arose.

USER/CONSUMER RESPONSIBILITIES

The user must ensure that their data is accurate, complete, and up to date and must promptly communicate any changes. If false statements are made, MOSTODOLCE SRL reserves the right to exclude such individuals from its user lists after issuing a formal, unaccepted correction request.

PAYMENT METHODS

Payments for purchase contracts made through the app, website, or e-commerce platform can only be made by credit card or PayPal, and in cash only for home deliveries made directly by MOSTODOLCE SRL.
